IP Australia’s Proposed Fee Changes

IP Australia has published a draft of its Cost Recovery Implementation Statement (“CRIS”) 2024-2025 which outlines proposed fee changes for patents, registered designs and trade marks in Australia. IP Australia conducts a review of fees every 4 years. It is anticipated that the proposed changes will take effect in October 2024.

A summary of the key changes of the CRIS is provided below.

  • Filing and examination fees for patents are set to increase by around 10%.
  • All fees relating to patent oppositions and hearings are set to Double.
  • It is proposed that excess claims fees for more than 20 claims in an application would be payable at the time of requesting examination (which is currently payable at acceptance/allowance).
  • For designs, filing fees will reduce and post-registration examination fees will increase.
  • Fee for filing Application for Removal of a Trade Mark will increase.
  • For trade mark oppositions, the introduction of fees for the number of grounds beyond the first three.
