IP Australia extends period for requesting COVID-19 streamlined extensions of time to 31 July 2020

As previously report in our post on 15 May 2020, IP Australia introduced a new streamlined process for extension of time requests to assist applicants who have been impacted by COVID-19. This streamlined process was meant to be in place until at least 31 May 2020.

These arrangements have now been extended until 31 July 2020. Depending on the ongoing impact of COVID-19 pandemic, this period may be further extended beyond 31 July 2020.

Streamlined Extensions of Time Applicants who have been impacted by COVID-19 can obtain an extension of time of up to three months free of charge. For eligible requests, IP Australia will waive or refund the normal official extension of time fees.

The streamlined extension applies to most deadlines associated with Australian Patent, Design and Trade Mark rights. Notably, the streamlined extension does not apply to payment of renewal/maintenance fees, although the six month grace period is available.
