COVID-19: IP Australia Update

At this stage, IP Australia remains open and operates as per usual. However, hearings will no longer be held in person due to current “social distancing” restrictions and will instead be conducted by video conferencing, telephone or written submissions.

Extension of Time for Patents, Designs and Trade Marks

Where applicants have difficulties meeting certain deadlines due to the COVID-19 outbreak, an extension of time may be available. Any request for an extension of time will need to be supported by a Declaration setting out how the COVID-19 outbreak interfered with the applicant’s ability to timely meet their deadline.
