Patent Annuities in Australia
Laminar IP - Australian Patent Attorneys
Laminar IP is a boutique Intellectual Property firm based in Sydney, Australia. Our firm can assist patent owners with their patent annuities in Australia at fixed and affordable costs. We utilise the latest docketing systems to ensure that all patent annuities under our management are properly monitored and handled.
Australian Annuity Deadlines
An annuity fee must be paid to the Australian Patent Office each year to maintain a patent application and any subsequently granted patent in force.
For a standard patent application or standard patent, the first annuity fee is due four years from the filing date.
For an innovation patent application or innovation patent, the first annuity fee is due two years from the filing date.
Late Annuity Payments
It is possible to pay an annuity fee for a patent or patent application in Australia within 6 months of the annuity deadline. However, monthly late fees will become payable.
If an annuity fee is not paid within the 6-month "grace" period, the patent or patent application will cease/lapse.
