PCT Application - National Phase Entry

The deadline for entering the National Phase of an International (PCT) Application in New Zealand is 31 months from the earliest priority date. 


To enter the National Phase in New Zealand, the following documents and particulars are required:

  • The PCT Application Number and/or Publication Number; and

  • If the specification of the PCT Application was published in a language other than English:

    • a verified English translation of the specification as published; and

    • a verified English translation of any Article 34 amendments. 
       

Patent Application

To file a patent application in New Zealand, the following documents and particulars are required:

  • A copy of the specification and Abstract in English;

  • Full name, address and nationality of the applicant(s);

  • Full name, address and nationality of the inventor(s); and

  • If claiming Convention priority, details of the priority application(s).

Note:

  • No Power of Attorney is required.

  • No forms are required to be signed by the applicant(s) or inventor(s).

  • For any verified English translation, a Certificate of Verification completed by the translator must be provided.

  • A certified copy of the priority application(s) will not be required unless specifically requested by the Intellectual Property Office of New Zealand.

New Zealand Designs

To file a design application in New Zealand, the following documents and particulars are required:

  • Full name, address and nationality of the applicant(s);

  • Full name, address and nationality of the designer(s);

  • Representations (i.e., drawings) of the entire product embodying the design;

  • Generic name of the product embodying the design; and

  • If claiming Convention priority, details of the priority application(s).

Note:

  • An Authorisation of Agent form, executed by the applicant(s), is required but may be submitted after filing.

  • A certified copy of the priority application(s), along with a verified English translation thereof if not in English, is required but may be submitted after filing.

New Zealand Trade Marks

To file a trade mark application in New Zealand, the following documents and particulars are required:

  • Full name, address and nationality of the applicant(s);

  • The exact mark;

  • The goods and/or services for which registration is sought; and

  • If claiming Convention priority, details of the priority application(s).

Note:

  • No Power of Attorney is required.

  • No forms are required to be signed by the applicant(s).

  • International Classification is followed.

  • A certified copy of the priority application(s) will not be required unless specifically requested by the Intellectual Property Office of New Zealand.

  • Multiple class applications are possible.
