PCT Application - National Phase Entry

The deadline for entering the National Phase of an International (PCT) Application in Australia is 31 months from the earliest priority date. 


To enter the National Phase in Australia, the following documents and particulars are required:

  • The PCT Application Number and/or Publication Number; and

  • If the specification of the PCT Application was published in a language other than English:

    • an English translation of the specification as originally filed; and

    • an English translation of any Article 34 amendments. 
       

Standard or Innovation Patent Application

To file a standard or innovation patent application in Australia, the following documents and particulars are required:

  • A copy of the specification and Abstract in English;

  • Full name and address of the applicant(s);

  • Full name of the inventor(s); and

  • If claiming Convention priority, details of the priority application(s).

Note:

  • No Power of Attorney is required.

  • No forms are required to be signed by the applicant(s) or inventor(s).

  • A certified copy of the priority application(s) will not be required unless specifically requested by the Australian Patent Office.

  • There is no duty to disclose prior art.

Australian Designs

To file a design application in Australia, the following documents and particulars are required:

  • Full name and address of the applicant(s);

  • Full name of the designer(s);

  • Representations (i.e., drawings) of the entire product embodying the design;

  • Generic name of the product embodying the design; and

  • If claiming Convention priority, details of the priority application(s).

Note:

  • No Power of Attorney is required.

  • No forms are required to be signed by the applicant(s) or designer(s).

  • A certified copy of the priority application(s) will not be required unless specifically requested by the Australian Designs Office.

  • There is no duty to disclose prior art.

Australian Trade Marks

To file a trade mark application in Australia, the following documents and particulars are required:

  • Full name and address of the applicant(s);

  • The exact mark;

  • The goods and/or services for which registration is sought; and

  • If claiming Convention priority, details of the priority application(s).

Note:

  • No Power of Attorney is required.

  • No forms are required to be signed by the applicant(s).

  • International Classification is followed. 

  • A certified copy of the priority application(s) will not be required unless specifically requested by the Australian Trade Mark Office.

  • Multiple class applications are possible.
